CHAPTER II.

PROPERTY RIGHTS OF MARRIED WOMEN.

THE MARRIED WOMEN's PROPERTY ACT.

The rights and liabilities of married women with regard to the holding and dispensing of property are dealt with in The Married Women's Property Oct, Revised Statutes of Ontario, 1914, chapter 149.

By English law, in the absence of a settlement, property possessed by a woman at the time of her marriage became the property of her husband and could be disposed of by him in the absence of any marriage contract or settlement, but since 1859 a married woman may hold real and personal property, whether belonging to her before marriage or acquired by her after marriage, free from her husband's debts and obligations and from his control or disposition, and may dispose of the same without his consent in as full and ample a manner as if she were unmarried.
